SUPREME COURT CASE

The Supreme Court just ruled for my colleague Lynn Goldsmith against the Andy Warhol Foundation, The Warhol people resold an image of Prince which had been based on Lynn’s photograph. I often encountered Warhol in backstage photo-op situations, we were often the only two photographers allowed in. I was in the room as as a record company’s hired gun, I didn’t really know why Andy was there, I thought it was some sort of quirk, an affinity for being adjacent to fame. We often stood side-by-side, he would make one snapshot with his plastic flash camera, say nothing, and be the first to leave. Now as I read about the court case I realize his motivation for showing up was to create his own original images to use as references for his creations. He was aware of these licensing issues and this was his work-around. The reason he didn’t simply send an assistant was that being Andy Warhol was his ticket into the room, he couldn’t send a substitute. I never turned my camera on him out of a sense of respecting his privacy, but in this case he stepped out of the shadows and engaged in conversation with Ricky Nelson becoming fair game.
